Wrongful Death & Survival Action

I have lost my loved one as a result of another person’s negligent conduct or wrongful acts. What should I do now?

If your family member died due to someone’s negligence, you, as a deceased’s beneficiary (surviving family member such as spouse, children, parents, etc.), may have a wrongful death claim and/or survivorship claim against a negligent party or a wrongdoer and seek compensation for the damages. 

Under New Jersey’s Wrongful Death and Survivorship Laws, a wrongful death and survival action could be brought on behalf of the decedent’s family members for the loss of economic support, loss of future wages, medical expenses, funeral expenses, pain and suffering, grief, more. Further, a survival action claim could be brought by the estate of the decedent to help compensate for the decedent’s physical, psychological, and financial injuries leading up to the death such as conscious pain, suffering, loss of enjoyment of life, and loss of society. 

You should note that a formal wrongful death and survivorship Complaint against a negligent party or a wrongdoer must be filed within two years of the death. If you fail to file a Complaint within the statute of limitations, you will be forever barred from pursuing the claims.
